Child Support Committee Meeting March 31st in Montgomery

This memorandum is for the purpose of notifying each of you that the next Committee meeting is scheduled for Friday, March 31, 2006, beginning at 10 :00 a .m ., to be held in the Mezzanine Classroom of the Heflin-Torbert Judicial Building, Montgomery (same Judicial Building as previous meetings, but renamed). Parking is available in the Center for Commerce deck with the entrance on Hull Street roughly two blocks south of the Building . The parking deck code for March is 320.

Under existing law, upon the granting of a divorce, the court may award custody of the children of the marriage to either parent based upon the best interests of the child. This bill would specify that a child who has reached his or her 14th birthday may choose the parent with whom the child would live, unless the court determines the selected parent is unfit or that the choice is not otherwise in the best interests of the child or the child is the subject of a joint custody decree.

Shared Parenting Bill

Under existing law, there is a presumption that joint custody is in the best interest of a child if both parents request it in a divorce, but as a matter of practice, both parties do not share equally in the rearing of the child when joint custody is ordered by a court. Under existing law, parents who can not agree on the terms of custody are not required to participate in custody mediation. There are no standard provisions under existing law that a court is required to include in an order granting custody.

Under existing law, there is no specific crime for falsely reporting child abuse or neglect in a child custody proceeding. This bill would make it a crime to knowingly and intentionally make a false report of abuse or neglect in a child custody proceeding. This bill would provide for penalties for violations.

Under existing law, pursuant to court precedent, a court is required to order custody based on the best interest of the child. This bill would provide factors that the court would be required to consider in order to determine the best interest of the child in an original contest over the custody of a minor child.
